Procedure

Stage 1 – Notice
 

We draft and serve a legal notice upon your tenant and give your tenant a date to leave your property. In our experience, we find that this stage is all that is needed.

If your tenant still does not leave your property you will need to proceed to the second stage.
 

 

Stage 2 – Court Action
 

Our solicitors issue Court proceedings in the relevant County Court on the same day they receive instructions. In some cases the Court make an Order for Possession without the need to attend a hearing. For the remaining cases a hearing date is set and we instruct an advocate to attend with you to obtain an Order for Possession. The Courts normally give tenants 14 days to leave properties. 

 

Stage 3 – Bailiff
 

A Request for Warrant of Possession of Land is sent to the relevant County Court and thereafter an appointment with the bailiff is set. We do provide the option for an agent to attend the eviction on your behalf and a new set of keys will be delivered to you.
